  11. 8. Where required by law, winners' names and State or Territory of residence may be published as set out in Item H. By entering, entrants request that their full address not be published.
  9. If you are a winner:

    3. if you do not provide valid payment/claim details by the Prize Claim Deadline, you forfeit the Prize and no compensation is payable in lieu;
    4. you are responsible for any tax payable in connection with the Prize and should obtain your own advice;
    5. the Promoter may require proof of age, identity and residency, and completion of a declaration or release, before the Prize is paid;
    6. you grant NBLCo the right to use your name, likeness, biographical data and State/Territory for the purpose of publicising the Competition and its result; and
    7. if requested by NBLCo, you may be required and must agree to be filmed during the presentation of the Prize.
  10. If the Competition is not capable of running as planned (including because of technical failure, tampering, fraud, or any cause beyond the Promoter's reasonable control), the Promoter may, subject to any written direction of a relevant regulator, cancel, terminate, modify, suspend or delay the Competition.
  11. To the fullest extent permitted by law, NBLCo, Mega Rewards and their respective related bodies corporate, directors, officers, employees, contractors and agents (Entities) are not liable for, and you release each of them from, any loss or damage you may suffer in connection with the Competition or any Prize, including any act or omission of Mega Rewards or another third-party prize supplier in relation to a Prize. Nothing in these Terms and Conditions excludes rights under the Australian Consumer Law that cannot be excluded.
  12. Nothing in these Terms and Conditions generally affect your rights under Australian consumer law (as contained in Schedule 2 of the Competition and Consumer Act 2010 (Cth) and equivalent State and Territory fair trading legislation) regarding consumer guarantees to the extent that such consumer guarantees cannot be excluded by law. Other than these consumer guarantees, and subject to these Terms and Conditions, NBLCo makes no warranties about any prizes offered as part of the Competition, including warranties as to the quality, merchantability or fitness for purpose of such prizes.

This disclosure is a condition of Prize eligibility.
    3. Separately and optionally, you may consent to Mega Rewards enrolling you as a Mega Rewards subscriber and sending you marketing communications. This is presented as a separate tick box, is not required to enter or to be eligible for a Prize, and you may withdraw it at any time using the unsubscribe facility in each message.
    4. Mega Rewards handles your personal information in accordance with its privacy policy.
    5. Personal information may also be collected, used and disclosed as otherwise permitted or required by law.
  14. Other than as expressly stated, your participation does not entitle you to use any trade mark, copyright or other intellectual property of NBLCo or Mega Rewards.

  16. Any provision (or part thereof) of these Terms and Conditions that is prohibited or unenforceable in any jurisdiction is ineffective as to that jurisdiction to the extent of the prohibition or unenforceability. That does not invalidate the remaining provisions (or parts thereof) of these Terms and Conditions and does not affect the validity or enforceability of that provision (or part thereof) in any other jurisdiction.
  17. These Terms and Conditions and the NBL Tipping Rules contain the entire agreement between you and the Promoter in respect of the Competition and supersede all prior agreements and understandings.
